Welcome to Wayward Threads. These Terms of Service ("Terms") govern your access to and use of waywardthreads.golf (the "Site") and your purchase of products from Wayward Threads ("Wayward Threads," "we," "us," or "our"), a sole proprietorship based in Houston, Texas. By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. About Our Products — Vintage and Secondhand Goods

All products sold by Wayward Threads are **pre-owned, secondhand vintage items**. By their nature, these items have been previously owned and worn and **may show normal signs of wear consistent with their age**, including light fading, minor pilling, softened fabric, or other characteristics typical of vintage apparel. We inspect each item and describe its condition, measurements, and any notable flaws as accurately as we reasonably can in each product listing. Vintage sizing often differs from modern sizing; the measurements provided in each listing — not the size tag — are the authoritative description of fit.

2. No Brand Affiliation

Wayward Threads is an independent reseller of authentic secondhand apparel. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to any of the brands whose products we resell, including without limitation Nike, Adidas, Reebok, Polo Ralph Lauren, Ashworth, Cutter & Buck, Burberry, Greg Norman, Callaway, Titleist, Ping, or any other manufacturer. All brand names, logos, and trademarks appearing on the Site or on products are the property of their respective owners and are used solely to accurately identify and describe the genuine secondhand goods being resold, as permitted under the first sale doctrine and nominative fair use. We make no warranties on behalf of any original manufacturer, and no manufacturer warranty applies to any item we sell.

3. Eligibility

You must be at least 18 years old (or the age of majority in your state) to purchase from the Site.

4. Products, Pricing, and Availability

Our items are one-of-a-kind. Listing a product does not guarantee availability, and we reserve the right to cancel any order — including after confirmation — if the item is unavailable, was listed with a pricing or description error, or if we suspect fraud. If we cancel your order, we will refund you in full. Prices are in U.S. dollars and may change at any time. Product photos are representative; minor color variation may occur due to lighting and screens.

5. Orders and Payment

By placing an order you represent that the payment information you provide is accurate and that you are authorized to use the payment method. Payment is processed by third-party payment processors through our Shopify store. We reserve the right to refuse or cancel any order at our discretion.

6. Shipping and Returns

Shipping and returns are governed by our Shipping Policy and Refund Policy, which are incorporated into these Terms by reference.

7. Intellectual Property

The Site and its original content — including our name, logo, photography, product descriptions, and written content — are owned by Wayward Threads and protected by applicable intellectual property laws. You may not reproduce or use our content for commercial purposes without our written permission. This section does not apply to third-party trademarks described in Section 2. Any third party content, photography, or videography, is protected under Fair Use and or has been vetted to include Commercial Creative Commons licenses.

8. Prohibited Conduct

You agree not to use the Site for any unlawful purpose; to interfere with the Site's operation or security; to scrape, copy, or harvest content or data; to place fraudulent orders; or to misrepresent the condition of returned items.

9. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT VINTAGE ITEMS ARE FREE OF WEAR; SIGNS OF WEAR CONSISTENT WITH AN ITEM'S AGE AND THE LISTING DESCRIPTION ARE NOT DEFECTS. NOTHING IN THIS SECTION LIMITS YOUR RIGHTS UNDER OUR REFUND POLICY. SOME STATES DO NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WAYWARD THREADS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SITE OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. SOME STATES DO NOT ALLOW THE LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless Wayward Threads and its owner from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

12. Dispute Resolution — Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

(a) Informal resolution first. Before filing any claim, you agree to contact us at store.waywardgolf@gmail.com and give us 30 days to resolve the dispute informally.

(b) Binding arbitration. Any dispute arising out of or relating to these Terms, the Site, or any purchase that is not resolved informally shall be resolved by **binding individual arbitration** administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. Arbitration will take place in Houston, Texas, or, at your election, by remote/telephonic hearing or on written submissions. Payment of filing and arbitrator fees will be governed by the AAA's Consumer Arbitration Rules.

(c) Small claims carve-out. Either party may instead bring an individual claim in small claims court in Harris County, Texas, or in your county of residence, if the claim qualifies.

(d) Class action waiver. ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any form of class proceeding.

(e) Opt-out. You may opt out of this arbitration agreement by emailing store.waywardgolf@gmail.com within 30 days of your first purchase, stating your name, order number, and intent to opt out of arbitration.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs Section 12.

14. Changes to These Terms

We may update these Terms from time to time. The version posted on the Site at the time of your order applies to that order. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

15. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect, except that if the class action waiver is found unenforceable, the entirety of Section 12 shall be void. These Terms, together with the Shipping Policy, Refund Policy, and Privacy Policy, are the entire agreement between you and Wayward Threads.
